Umfang der Datenverarbeitung, Verarbeitungszwecke und Rechtsgrundlagen<\/b><\/p>\n<p>Den Umfang der Verarbeitung der Daten, Verarbeitungszwecke und Rechtsgrundlagen f\u00fchren wir im Detail weiter unten aus. Als Rechtsgrundlage f\u00fcr eine Datenverarbeitung kommen grunds\u00e4tzlich die folgenden in Betracht:<\/p>\n<ul>\n<li>Art. 6 Abs. 1 S. 1 lit. a DSGVO dient uns als Rechtsgrundlage f\u00fcr Verarbeitungsvorg\u00e4nge, f\u00fcr die wir eine Einwilligung einholen.<\/li>\n<li>Art. 6 Abs. 1 S. 1 lit. b DSGVO ist Rechtsgrundlage, soweit die Verarbeitung personenbezogener Daten zur Erf\u00fcllung eines Vertrages erforderlich ist, z.B. wenn ein Seitenbesucher von uns ein Produkt erwirbt oder wir f\u00fcr ihn eine Leistung ausf\u00fchren. Diese Rechtsgrundlage gilt auch f\u00fcr Verarbeitungen, die f\u00fcr vorvertragliche Ma\u00dfnahmen erforderlich sind, etwa bei Anfragen zu unseren Produkten oder Leistungen.<\/li>\n<li>Art. 6 Abs. 1 S. 1 lit. c DSGVO findet Anwendung, wenn wir mit der Verarbeitung personenbezogener Daten eine rechtliche Verpflichtung erf\u00fcllen, wie es z.B. im Steuerrecht der Fall sein kann.<\/li>\n<li>Art. 6 Abs. 1 S. 1 lit. f DSGVO dient als Rechtsgrundlage, wenn wir uns zur Verarbeitung personenbezogener Daten auf berechtigte Interessen berufen k\u00f6nnen, z.B. f\u00fcr Cookies, die f\u00fcr den technischen Betrieb unserer Website erforderlich sind.<\/li>\n<\/ul>\n<p><b>1.3. Datenverarbeitung au\u00dferhalb des EWR<\/b><\/p>\n<p>Soweit wir Daten an Dienstleister oder sonstige Dritte au\u00dferhalb des EWR \u00fcbermitteln, garantieren Angemessenheitsbeschl\u00fcsse der EU-Kommission nach Art. 45 Ab. 3 DSGVO die Sicherheit der Daten bei der Weitergabe, soweit diese vorhanden sind, wie dies z.B. f\u00fcr Gro\u00dfbritannien, Kanada und Israel der Fall ist.<\/p>\n<p>Bei der Datenweitergabe an Dienstleister in den USA, ist Rechtsgrundlage f\u00fcr die Datenweitergabe ein Angemessenheitsbeschluss der EU-Kommission, wenn sich der Dienstleister zus\u00e4tzlich unter dem EU US Data Privacy Framework zertifiziert hat.<\/p>\n<p>In anderen F\u00e4llen (z.B. wenn kein Angemessenheitsbeschluss existiert), sind Rechtsgrundlage f\u00fcr die Datenweitergabe im Regelfall, also soweit wir keinen abweichenden Hinweis geben, Standardvertragsklauseln. Diese sind ein von der EU-Kommission verabschiedetes Regelwerk und Teil des Vertrags mit dem jeweiligen Dritten. Nach Art. 46 Abs. 2 lit. b DSGVO gew\u00e4hrleisten sie die Sicherheit der Datenweitergabe. Viele der Anbieter haben \u00fcber die Standardvertragsklauseln hinausgehende vertragliche Garantien abgegeben, die die Daten \u00fcber die Standardvertragsklauseln hinaus sch\u00fctzen. Das sind z.B. Garantien hinsichtlich der Verschl\u00fcsselung der Daten oder hinsichtlich einer Pflicht des Dritten zum Hinweis an Betroffene, wenn Strafverfolgungsorgane auf Daten zugreifen wollen.<\/p>\n<p><b>1.4. Speicherdauer<\/b><\/p>\n<p>Sofern nicht im Rahmen dieser Datenschutzerkl\u00e4rung ausdr\u00fccklich angegeben, werden die bei uns gespeicherten Daten gel\u00f6scht, sobald sie f\u00fcr ihre Zweckbestimmung nicht mehr erforderlich sind und der L\u00f6schung keine gesetzlichen Aufbewahrungspflichten entgegenstehen. Sofern die Daten nicht gel\u00f6scht werden, weil sie f\u00fcr andere und gesetzlich zul\u00e4ssige Zwecke erforderlich sind, wird ihre Verarbeitung eingeschr\u00e4nkt, d.h. die Daten werden gesperrt und nicht f\u00fcr andere Zwecke verarbeitet. Das gilt z.B. f\u00fcr Daten, die wir aus handels- oder steuerrechtlichen Gr\u00fcnden aufbewahren m\u00fcssen.<\/p>\n<p><b>1.5. Rechte der Betroffenen<\/b><\/p>\n<p>Betroffene haben gegen\u00fcber uns folgende Rechte hinsichtlich der sie betreffenden personenbezogenen Daten:<\/p>\n<ul>\n<li>Recht auf Auskunft,<\/li>\n<li>Recht auf Berichtigung oder L\u00f6schung,<\/li>\n<li>Recht auf Einschr\u00e4nkung der Verarbeitung,<\/li>\n<li><b>Recht auf Widerspruch gegen die Verarbeitung<\/b>,<\/li>\n<li>Recht auf Daten\u00fcbertragbarkeit,<\/li>\n<li><b>Recht, eine erteilte Einwilligung jederzeit zu widerrufen<\/b>.<\/li>\n<\/ul>\n<p>Betroffene haben zudem das Recht, sich bei einer Datenschutz-Aufsichtsbeh\u00f6rde \u00fcber die Verarbeitung ihrer personenbezogenen Daten zu beschweren. Kontaktdaten der Datenschutz-Aufsichtsbeh\u00f6rden sind unter https:\/\/www.bfdi.bund.de\/DE\/Service\/Anschriften\/Laender\/Laender-node.html abrufbar.<\/p>\n<p><b>1.6. Pflicht zur Bereitstellung von Daten<\/b><\/p>\n<p>Kunden, Interessenten oder Dritte m\u00fcssen uns im Rahmen einer Gesch\u00e4ftsbeziehung oder sonstigen Beziehung nur diejenigen personenbezogenen Daten bereitstellen, die f\u00fcr die Begr\u00fcndung, Durchf\u00fchrung und Beendigung der Gesch\u00e4ftsbeziehung oder f\u00fcr die sonstige Beziehung erforderlich sind oder zu deren Erhebung wir gesetzlich verpflichtet sind. Ohne diese Daten werden wir in der Regel den Abschluss eines Vertrages oder die Bereitstellung einer Leistung ablehnen m\u00fcssen oder einen bestehenden Vertrag oder sonstige Beziehung nicht mehr durchf\u00fchren k\u00f6nnen.<\/p>\n<p>Pflichtangaben sind als solche gekennzeichnet.<\/p>\n<p><b>1.7. Keine automatische Entscheidungsfindung im Einzelfall<\/b><\/p>\n<p>Zur Begr\u00fcndung und Durchf\u00fchrung einer Gesch\u00e4ftsbeziehung oder sonstigen Beziehung nutzen wir grunds\u00e4tzlich keine vollautomatisierte Entscheidungsfindung gem\u00e4\u00df Artikel 22 DSGVO. Sollten wir diese Verfahren in Einzelf\u00e4llen einsetzen, werden wir hier\u00fcber gesondert informieren, sofern dies gesetzlich geboten ist.<\/p>\n<p><b>1.8. Kontaktaufnahme<\/b><\/p>\n<p>Bei der Kontaktaufnahme mit uns, z.B. per E-Mail oder Telefon, werden die uns mitgeteilten Daten (z.B. Namen und E-Mail-Adressen) von uns gespeichert, um Fragen zu beantworten. Rechtsgrundlage f\u00fcr die Verarbeitung ist unser berechtigtes Interesse (Art. 6 Abs. 1 S. 1 lit. f DSGVO), an uns gerichtete Anfragen zu beantworten. Die in diesem Zusammenhang anfallenden Daten l\u00f6schen wir, nachdem die Speicherung nicht mehr erforderlich ist, oder schr\u00e4nken die Verarbeitung ein, falls gesetzliche Aufbewahrungspflichten bestehen.<\/p>\n<p><b>1.9. Kundenumfragen<\/b><\/p>\n<p>Von Zeit zu Zeit f\u00fchren wir Kundenumfragen durch, um unsere Kunden und ihre W\u00fcnsche besser kennenzulernen. Dabei erheben wir die jeweils abgefragten Daten. Es ist unser berechtigtes Interesse, unsere Kunden und ihre W\u00fcnsche besser kennenzulernen, so dass Rechtsgrundlage der damit einhergehenden Datenverarbeitung Art. 6 Abs. 1 S. 1 lit f DSGVO ist. Die Daten l\u00f6schen wir, wenn die Ergebnisse der Umfragen ausgewertet sind.<\/p>\n<p><b>2. Newsletter<\/b><\/p>\n<p>Wir behalten uns vor, Kunden, die bereits Dienstleistungen von uns in Anspruch genommen haben oder Waren gekauft haben, von Zeit zu Zeit per E-Mail oder auf anderem Weg elektronisch \u00fcber unsere Angebote zu informieren, falls sie dem nicht widersprochen haben. Rechtsgrundlage f\u00fcr diese Datenverarbeitung ist Art. 6 Abs. 1 S. 1 lit. f DSGVO. Unser berechtigtes Interesse liegt in der Direktwerbung (Erw\u00e4gungsgrund 47 DSGVO). Kunden k\u00f6nnen der Verwendung ihrer E-Mail-Adresse zu Werbezwecken jederzeit ohne zus\u00e4tzliche Kosten widersprechen, zum Beispiel \u00fcber den Link am Ende einer jeden E-Mail oder per E-Mail an unsere oben genannte E-Mail-Adresse.<\/p>\n<p>Interessenten haben die M\u00f6glichkeit, einen kostenlosen Newsletter zu abonnieren. Wir verarbeiten die bei der Anmeldung angegebenen Daten ausschlie\u00dflich f\u00fcr den Versand des Newsletters. Die Anmeldung erfolgt \u00fcber die Auswahl des entsprechenden Feldes auf unserer Website, durch Ankreuzen des entsprechenden Feldes in einem Papierdokument oder durch eine andere eindeutige Handlung, wodurch Interessenten ihr Einverst\u00e4ndnis in die Verarbeitung ihrer Daten erkl\u00e4ren, so dass Rechtsgrundlage Art. 6 Abs. 1 S. 1 lit. a DSGVO ist. Die Einwilligung kann jederzeit widerrufen werden, z.B. durch Klicken des entsprechenden Links im Newsletter oder Hinweis an unsere oben angegebene E-Mail-Adresse. Betroffene k\u00f6nnen ihre Einwilligung jederzeit widerrufen, indem sie uns z.B. unter den in unserer Datenschutzerkl\u00e4rung angegebenen Kontaktdaten kontaktieren.
